Jeffery Turnbull has been acquitted of charges of sexual assault against a fellow Hamilton police officer in 2022 after a trial that commenced in January. Ontario Justice Jennifer Marie Campitelli delivered her verdict in Burlington, stating she found the complainant’s testimony not credible or reliable and sided with Mr. Turnbull.
During the trial, Crown prosecutor Jason Nicol alleged that Turnbull engaged in inappropriate behavior towards the younger officer, including making sexual remarks, sending unsolicited messages and gifts, and touching her without consent before the alleged assault in March 2022. The complainant testified that Turnbull persistently communicated with her, gave her gifts, flirted, and even sent nude photos. She also claimed he would discuss his mental health issues and threaten suicide to manipulate her.
The woman recounted visiting Turnbull’s home in the absence of his wife, where she alleged he assaulted her despite her objections. The defense countered by suggesting a consensual affair between the two, presenting text messages as evidence. Turnbull maintained that their encounter was consensual, and the defense argued that the Crown failed to prove non-consent beyond a reasonable doubt.
Justice Campitelli summarized the arguments from both sides, highlighting discrepancies in the complainant’s version of events. She found Turnbull’s testimony credible and consistent with evidence, while she deemed the woman evasive and dishonest in her account. Campitelli pointed out inconsistencies in the complainant’s recollection of dates and gifts received from Turnbull, ultimately concluding that the Crown could not establish lack of consent.
Throughout the trial, both parties had union representatives supporting them, with internal affairs and police oversight agencies present. Jaimi Bannon of the Hamilton Police Association acknowledged the challenging process for all involved and assured support for both members moving forward. The next steps involve potential internal investigations by the Hamilton Police Service, keeping Turnbull suspended with pay and the complainant on duty.
